What Chime's marketing dispute means for financial brands

The news: J.D. Power is suing Chime over its marketing claim that it’s “America’s #1 Choice for Banking,” per BankingDive.

Zoom in: According to the lawsuit, Chime based its claim on a J.D. Power benchmarking study that tracked new account openings across eight consumer banking categories. However, Chime led in only one category: new checking account openings.

J.D. Power argues that using this single metric to support a broad “#1 Choice for Banking” claim is misleading. The data analytics firm alleges it warned Chime in November 2025 that it could not use the claim but that Chime continued and expanded use of the messaging in advertising, press releases, U.S. Securities and Exchange Commission materials, and a trademark application.

Why this matters: As competition for deposits and new customers intensifies, providers increasingly rely on bold performance claims to differentiate themselves. But this dispute underscores the importance of ensuring those claims withstand scrutiny from research firms, regulators, and consumers.

Implications for banks: Beyond legalities, the case highlights the reputational risks financial providers face when marketing claims are challenged publicly. J.D. Power also wants Chime to undertake corrective advertising to address potential consumer confusion.
