The trend: The FDA sent 28 untitled and warning letters challenging prescription drug promotions through August, more than four times the number issued in any full year from 2020 through 2024, per FDA data. The current enforcement push began on September 9, 2025, when 61 letters went out following President Trump's directive for federal regulators to crack down on misleading direct-to-consumer (D2C) drug ads. At the same time, HHS and FDA pledged a “more expansive reading” of the FDA’s authority than under prior administrations.
