The news: Google is paying fees to approximately 100 publishers whose content informs AI Overviews and other products, The Information reported Wednesday.
The move is a remarkable 180 for Google, which has vigorously argued that it does not need to pay publishers because its use of content to train AI qualifies as fair use—a legal doctrine that allows limited use of copyrighted material if it is meaningfully altered or commented on.
Payouts are unlikely to appease the publishing industry: Some amount to less than one-tenth of 1% of certain publishers’ ad revenues, The Information reports. Those measly sums haven’t attracted the interest of larger publishers.
Zooming out: Google and other AI providers are in legal hot water over scraping publisher content to inform AI responses, which have cratered traffic to news publications. Recent Similarweb data found that traffic to the top 100 news publishers fell 21% from August 2021 to August 2026. Other individual publishers have reported declines of more than 50%. Meanwhile, Google’s internal traffic has grown.
The growing pile of litigation could result in heavy penalties for Google or rulings that threaten the way it trains its AI models. A group of 300 news publishers is headed to DC this week to pressure lawmakers to take action against AI bot scraping.
Implications for marketers: AI search summaries are helping walled gardens capture an even larger share of programmatic spending as open web inventory gets devalued. Walled gardens will control 80.4% of the programmatic digital display ad market in 2026, per our forecast.
These payments alone likely won’t help Google avoid legal or regulatory blockages. It may face consequences further down the line that fundamentally alter its models, like extricating scraped content or limiting AI Overview appearances.
But if the payout program does take some pressure off AI platforms, it will mean a drip feed of revenues for publishers—though slipping traffic won’t help ad spend rebound.
