The news: Apple filed a lawsuit against OpenAI on Friday accusing the company of trade secret theft. Specifically, Apple’s lawsuit claims OpenAI orchestrated a systematic theft of Apple’s intellectual property to build its own consumer hardware, per CNBC.
The filing names OpenAI's hardware chief, Tang Tan, a former Apple design VP. It alleges Tan directed job candidates still working at Apple to bring physical parts to job interviews for "show and tell" sessions. Tan and former Apple design chief Jony Ive founded io, the startup OpenAI acquired last year.
"We have no interest in other companies' trade secrets, (we) remain focused on building innovative technology that empowers people everywhere," OpenAI spokesperson Drew Pusateri said on X.
Zooming in: The suit marks a stunning collapse of a 2024 partnership that integrated ChatGPT into iPhones and Macs. Apple says OpenAI has hired more than 400 former Apple employees across engineering, hardware and design teams, per Morning Brew, deepening Apple's concern that its talent pipeline has become OpenAI's recruiting ground.
Industry implications: OpenAI is burning through tech industry goodwill. Apple joins Microsoft and co-founder Elon Musk as tech's most powerful entities all in active or recent dispute with OpenAI.
Ongoing litigation could slow down OpenAI's momentum as it barrels toward its IPO. Its work on competitive frontier AI models could take a backseat to mounting legal pushback from various fronts.
Brands should vet AI partners for legal liabilities as rigorously as for technical capability. A model with superior performance means nothing if your vendor is distracted by federal lawsuits, depositions and injunctions.
